Terms and Conditions
By purchasing a ticket for the Tour, you agree to these Terms and Conditions, which are a legally binding agreement between you and Merchantour LLC (“Organizer”). Please read them carefully.
Ticket Refund Policy:

All ticket sales are final and non-refundable.

No refunds will be given if the customer fails to show up at the designated pick-up point on time.

Tickets cannot be exchanged for another date or time. Tickets are non-refundable.

No refunds will be given for late arrivals. The bus will depart strictly at the time stated below.

No exceptions will be made for personal emergencies, illness or other unforeseen circumstances, except as required by law.

Refunds will only be given if the Tour is cancelled by the Organizer. Refunds will be processed within 5 to 10 business days.

Group Tour Terms:
You are purchasing a ticket for a group Tour. Group size may vary depending on the number of tickets sold.
Transportation Details:

If there are fewer than 6 participants: The tour will be operated in a large, comfortable GMC Yukon XL SUV.

If there are 6 to 14 participants: The tour will be operated in a Sprinter or Ford Transit minivan.
-
If there are more than 14 participants: The tour will be operated in a large 56-passenger bus.

By purchasing a ticket, you agree that there may be between 1 and 55 other participants on the tour.
Seats and Tickets:

While every effort is made to accommodate your preferred seat, we cannot guarantee that your seat will match the diagram shown at the time of booking.

Due to changes in vehicle models and seating arrangements, your ticket entitles you to participate in the tour, but does not guarantee a specific seat.
Stops during the Tour:

There is no lunch stop on the tour.
-
The program includes stops where all passengers must disembark from the vehicle with the guide.

You are responsible for staying with the group during stops. In the event that you become lost, the bus will continue the route without you.

The bus will not return for participants who are lost or late.

Tour Program:

The list of attractions included in the Tour is posted on the Tour description page or here.

We make every effort to show all the stated attractions, but we cannot guarantee that you will visit each of them.

Visibility of some objects may depend on your seat in the vehicle.

We cannot guarantee a direct view of all attractions from the bus.
-
In the event of road works, street closures, government events, parades, festivals and other force majeure circumstances, some attractions may not be accessible.
Tour Duration:

The duration of the Tour is approximately 6 hours.

Due to the complexity of the route, exact adherence to the schedule cannot be guaranteed.

The tour ends at two points:

First drop-off point: Grand Central Station from approximately 3:00 PM to 3:30 PM
-
Second drop-off point: Brighton Beach from approximately 4:00 PM to 4:30 PM
Participant behavior:

The organizer reserves the right to refuse participation in or remove from the Tour any participant whose behavior threatens the safety, comfort or well-being of other participants or disrupts public order.
Age restrictions and responsibility for children:

Children under 18 years of age may participate in the Tour only if accompanied by an adult who is fully responsible for their behavior and safety
Right to change the route:

The organizer reserves the right to make changes to the route, schedule and program of the Tour if necessary, without prior notice to the participants.
Insurance:

The Tour Organizer recommends that participants have valid Travel and Medical Insurance. The Organizer does not provide insurance and is not responsible for medical expenses or other costs incurred as a result of participation in the Tour.
Health and Safety of Participants:

Participants are responsible for ensuring that their health condition allows them to participate in the Tour. The Organizer is not responsible for any health problems that arise during the Tour or after its completion.
Force Majeure:

The Organizer is not responsible for cancellation, delay or change in the Tour program in the event of force majeure, including, but not limited to: natural disasters, strikes, epidemics, military actions, terrorist acts and other events beyond the control of the Organizer.
Limitation of liability:

To the maximum extent permitted by law, the Organizer disclaims any liability for indirect, incidental, special or consequential damages arising in connection with the Tour or as a result of its implementation, including, but not limited to, personal injury, damage to property or loss of enjoyment of participation in the Tour, except in cases of gross negligence or willful misconduct on the part of the Organizer. The Organizer is not responsible for the loss, theft or damage to personal belongings during the Tour. In any event, the total liability of the Organizer cannot exceed the amount paid for the ticket for the Tour.
Disclaimer of liability for transport company services:

The Organizer provides only tour guide services. Transportation services for the Tour are provided by a third-party transport company that operates independently and is not associated with the Organizer or the company selling the tickets. By purchasing a ticket, you acknowledge that the Organizer is not responsible for the operation, safety, maintenance or quality of the transportation services provided. All issues related to the transportation services, including but not limited to delays, technical failures or accidents, are the sole responsibility of the third party transportation company.
Disclaimer for sales through third party platforms:

Tickets for this Tour may be sold through third party websites or authorized resellers. The Organizer is not responsible for the activities, policies, content or customer service provided by these third party platforms. Any issues related to payment, ticket processing or website operation should be addressed directly with the relevant third party provider.

By purchasing a ticket on a third party website, you acknowledge and agree that your contractual relationship for the provision of the Travel Services remains solely with the Organizer, as defined in these Terms and Conditions.
Consent to Use Photos and Videos:

By participating in the Tour, you consent to the Organizer using photos and videos of you for advertising purposes without payment of any compensation.
Applicable Law and Jurisdiction:

These Terms are governed by the laws of the State of New York. Any disputes arising in connection with these Terms shall be resolved in the courts of New York County, New York.
Severability Clause:

If any provision of these Terms is found invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions, which will remain in full force and effect.
By purchasing a ticket, you agree to release, waive and discharge from the Organizer any and all claims, demands or causes of action arising out of participation in the Tour, except as required by law.
